The Post reports that a dozen Lehman Brothers executives have been subpoenaed, including you know who, in a grand jury investigation led by the US attorney’s offices in the Eastern and Southern districts of New York and the district of New Jersey. The Brothers are being represented by Weil, Gotshal & Manges’s Harvey Miller, who’s probably working on his defense of an line dropped to David Einhorn from Fuld post catfight with Erin Callan admitting “you might be onto something” and offering him E to the C’s job. In addition to probing whether or not higher ups made “false comments” about the health of the firm prior to it biting the big one, prosecutors will also attempt to ascertain once and for all if the Gorilla went two-for-two re: losing fistfights in the company gym last month.
