    Massachusetts’ top securities regulator accused executives of a New York unit of Oppenheimer Holdings Inc. with “unloading” $3 million of their personal holdings in auction-rate securities in the two weeks before the market for the investments imploded in February.
    The state’s civil-fraud complaint seeks to fine the Canadian company’s money manager, Oppenheimer & Co., and three of the unit’s officials, including the chief executive officer and chairman, Albert Lowenthal, and his son, Robert, a senior managing director. The complaint also names two other executives who sold auction-rate securities but doesn’t seek fines against them.
    Massachusetts Secretary of State William Galvin, in an interview, said the executives “betrayed the trust of their clients.” He alleged they kept their clients “in the dark, even as they, themselves, got out of that tottering market.”
    In a statement, Oppenheimer denied the allegations and said it intends to “vigorously defend itself.” The company said that “while there were sales by executives of auction-rate securities, there were also executive purchases during this period and these same executives continue to hold millions of dollars of auction-rate securities.” Oppenheimer said it continues to work with regulators and “financing sources” to find “a means for its clients to find liquidity from their auction-rate holdings.”
    The complaint is part of a crackdown this year on Wall Street sellers of the arcane auction products — debt instruments that some brokers peddled as liquid, cash-like investments. The rates had been reset weekly or monthly in auctions conducted by Wall Street firms. But in the second week of February, dealers stopped supporting the market with bids. Customers couldn’t sell the investments, which plunged in value.
    Mr. Galvin’s office gathered testimony and sale records, which said that as Oppenheimer officials discussed problems in the auction-rate securities market, several sold personal holdings between Feb. 1 and Feb. 12. The market collapsed between Feb. 12 and Feb. 14. In Massachusetts, Oppenheimer customers with 176 accounts were unable to access nearly $56 million, and many still can’t, Mr. Galvin said.
    The state wants Oppenheimer to repay customers who sold at a loss and to make whole those who can’t sell. The state is also seeking a formal censure of the firm, as well as fines for Albert and Robert Lowenthal and for Greg White, managing director of the firm’s auction-rate securities division. Regulators also want to revoke the state broker-dealer registration of the senior Mr. Lowenthal.
    Albert Lowenthal and Mr. White didn’t return phone calls seeking comment. Robert Lowenthal referred a call to Oppenheimer’s spokesman, who declined to comment beyond the company’s statement.
    More than a dozen banks and securities companies have reached agreements with regulators in recent months to repurchase more than $50 billion in auction-rate securities at par, from mostly retail and smaller investors. The agreements settle allegations that the banks made misrepresentations in their marketing and sales of the securities.

    @14 – One senior futures guy that I know of for certain. They pretty much shut down the equity sales & trading team in Chgo. From what I hear, the severance packages were the worst to date. All the depth is gone. What’s left (those making the decisions)are the bottom of the barrell. The surviving middle managers are struggling to get as far up sr. management’s butts as they can. These remaining managers are the ones putting people’s names in the hat! The place is going to implode.

    I got layed off awhile ago from a BB, was unemployed for a long time, ran up debts, and am now working at a boutique bank. Ideal? Hell no, but it’s a job. People need to stop whining. It’s okay to have a little sympathy, but let’s keep things in perspective, this is a high-risk, high-reward industry. It is what it is.
    At least those that are layed off have skills and an education to pick up somewhere else. It’s not like the janitor or HR rep are getting layed off.
