CNBC reports that U.S. Attorney Michael Garcia will not seek criminal charges against Eliot Spitzer. Mr. Dupre said in a statement, “I appreciate the impartiality and thoroughness of the investigation.” Anyone have any idea how he managed to worm his way out of this one?

Seaman is actually pretty close as to the reason… I know some folks that were advising the prosecution and the general thought was “This guy is a total asshole that deserves to get fucked by the same bullshit he fucked others on… but that doesn’t make it right.” Going around hanging people on technical violations of laws that were not meant to be used in that manner is something we should support (even though, if anyone deserves it, it is this guy). Then again, maybe the prosecution just ignored the advice they were given and dumped it for other reasons.
The guy’s life is ruined anyway, all he is avoiding is prison time he shouldn’t have to serve.

@43 .. His life is far from ruined, he’s got plenty of money, work in real estate, and a very comfortable life. Not prosecuting him for a crime that everyone knows he did is pretty bad. He should have been convicted, even if they just gave him a slap on the wrist punishment.
