@20 - what I don't understand (as someone who works at a hedge fund and is also an investor), how did he make it through an audit every year? Every investor gets audited financials, and sure, auditors have been duped by fraud before and will again, but this guy had to jump through hoops to make sure the auditors didn't catch on.

Don't forget the broader lesson in all of this. A determined, sophisticated fraud can take place anywhere within the money flow chain. For example, if you have a good old equity account, you need brokers to execute trades and a custodian to 'safeguard' the assets. All you have to rely on are statements of your supposed account activity. When you read those statements, can you really be 100% sure the assets are actually there? No, you can't. Or, you have a money market account on which you get regular statements. What if someone stole that money six months ago and is falsifying those statements? All looks kosher, but it ain't. Truth is, you wouldn't know or even suspect.

Madoff showed pages and pages of trades to his investors. The administrator, apparently, also saw the treasury and investment positions, all supporting the alleged trading method. In other words, this guy produced compelling documentation to back his supposed strategy. That takes some organisation and a degree of 'sophistication' to accomplish. (You also have to be pretty evil.)

When some people talk about due diligence, what exactly do they mean? If a manager produces audited statements, is apparently transparent with the exact nature of his trades (not exactly typical in the hedge fund world, after all) and employs a third-party administrator, what more can anybody do? You can't actually sit in their office or home each day to see what's really going on. Even if you did that for a whole year, who's to say the money isn't filched away as soon as you step out the door?

I don't believe Madoff conceived of this massive fraud back in 1991. This undoubtedly started off as a legitimate investment operation. For how long? Who knows. Of course, the likelihood is that trading results tailed off or were poor and his ego couldn't take it. When might that have happened? Again, who knows.

Finally, on the subject of auditors; don't kid yourselves. Having a big named firm is no evidence of anything, other than huge fees. Just look at Lancer, Manhattan and others. Anyone with any involvement with auditors knows that their main aim is to preclude themselves from any liability. Hell, you have to sign papers these days specifically absolving them of anything just to engage them. Some protection for investors!

It's hard to be sympathetic to some of the so-called victims. The Wilpon's for example - both Fred and his son Jeff are some of the most arrogant S.O.B.'s in the world of baseball. The story of Jeff punching out a guy waiting in line for the WDC-NYC shuttle (what? a billionaire can't afford his own charter?) and then siccing a team of lawyers to keep the assault out of court and the papers is a classic example of what sort of scum they are.

Oh, wait - and here's another victim.. a charity called the The Robert I. Lappin Charitable Foundation which closed. Their mission "... is helping to keep our children Jewish, thus reversing the trend of assimilation and intermarriage." The last time I heard something like that was my grandfather who warned me if I married that Japanese girl I was dating, our kids would come out as undesirable half-breeds - and that of course, he'd strike me out of his will. I think the word used to describe dear old granddad was "racist"...

Yes Madoff is a crumb of crumbs, but his rthnicity should not be a measure of who he is. Many of the comments were very racist and the people that made them are as much at fault as Madoff. There rhetoric causes hatred and violence. Maydoff should not have been given any bail, and should be in jail. Why the judge just gave him a pat on the wrist makes no sense. Yes he has to wear a monitoring device, but he will wear it in a 7 million dollar condo, with maid service and all. His sentence could be 50 years in a Federal Prison. Its obvious that his past status allowed this very light bail sentence. 10 million sounds like a lot of money, but not when you have real estate collateral of voer 30 million. The bail should have been set at over 100 million. He has hurt so many people and many good friends. He was smiling when the reporters got to him as he was entering his condo. He didn't car at all about the people he hurt. As far as we know, this whole thing could have been Orchestrated prior to his confession. Money secreted away in off shore banks under assumed names. I cannot believe for one second that his sons, brother and wife and niece are not involved. Its so obvious it is a family Conspiracy. His sons wife and niece will enjoy much prosperity, and he will probably get out of jail at some pardon hearing with a minimum of time served. Maybe he get what he deserves from other inmates where he will be incarcerated.

Madoff probably started legit and then engaged in (initially minor) fraud to keep up an aura of consistency.

Once he became enamoured of his "reputation" however - there was no easy way to unwind (he could have reported sub-optimal gains during the bull market in order to "get right" with his accounts - but probably feared that consistent underperformance would have triggered redemptions before he could "uncook" the books).

My guess is that he eventually reconciled to the fraud. Figured he'd die within the next few years - leave the horror to be discovered by survivors. The financial meltdown (and unexpected redemptions) occured too soon for his plans.

Wouldn't be surprised if he commits suicide.

One should hope he commits suicide. If not, all he'll probably receive is a slap on the wrist. Don't be surprised if the taxpayers -- largely non-jews -- bail out the jewish organizations and investors Madoff cheated.

As for the financial meltdown, yes this probably helped to reveal Madoff's scheme. And the financial meltdown is again a product of the jews on wall street. Their predatory lending practice -- an extension of their LONG tradition of usury -- created this mess. Their lies and swindling blew up in their faces and now WE non-jews must rescue them so they can start the process anew.

I think they deserve to lose and rethink their strategies.

This piece of garbage deserves to rot in prison, but I'm sure the people who he raped feel he deserves far worse. He definitely doesn't represent the vast majority of Jews, yet I've seen people use his despicable acts as justification for going after ALL Jews. Please understand that the unforgivable acts of a lowlife scumbag like Madoff in no way speaks for the millions of decent, hardworking and honorable Jews (and non-Jews) throughout the world. As a Jew myself, I see Madoff as a disgusting excuse for a human being. I'm outraged that he's under house arrest rather than fighting off boyfriends in prison where he belongs. I am a gentile and most of the Jews that I come accross are decent people. Some of the most generous and giving people I know are Jews.

We need to put things in perspective and not let a few bad Jews ruin the reputation of an entire group.

Unfortunately, crooks like Madoff, Milken, and Boesky have cheated many non-Jews and perpetuates the negative Jewish stereotypes. I for one, would like to see some prominent Jewish leaders; such as, Rabbis, Joseph Lieberman, etc, step up and denounce some of these schemes carried out by one of their own.

Why is it that religion only becomes a factor when the perpetrator is Jewish? If Madoff were a Catholic would there be such a backlash of anti-Catholic rhetoric on this blog? 131 Good points. Consider though that Madoff appears to have promoted his scheme on the basis of being Jewish. Focused on friends, Jewish charities, contacts through Jewish clubs. Promoted the idea of trusting a fellow Jew. The fact that he exploited his Jewishness means that you can't ignore his religion when discussing the crime.

Dear poster #127, The Bible was written several thousand years ago to have to do with the society of that time. They were talking about idol worshippers and those who sacrifice their children to appease their gods. It is insane to think that words written then about Biblical society apply today. I think it is interesting that you skip over Abraham welcoming the strangers, trying to save the people of Sodom, Joseph saving the Egyptians from starvation, Ruth who found the Jews so benevolent she converted, and more. Jews believe that you should love another as you would love yourself. Jews believe that everyone is created equally in God's image. Jews have contributed to the betterment of society in spite of the small percentage they are in the world population. Occasionally there is a bad egg but weighed against Jewish contributions to medical science, literature, music, the arts, and technology it is an unfortunate and tragic event.

DOES ANYONE KNOW: A co-worker of mine is claiming that he watched a televised news story (20-20?) in which it was stated that Madoff only allowed Jewish investors... that if you were not Jewish, Madoff made it almost impossible for you to get connected with him. --- I have been reading stories all over the internet, trying to find out if my co-worker's statements are actually true. I have seen articles that list non-Jewish victims of Madoff, so... What is the true story here? I would like to learn whether my co-worker's statements are true or not. Did Madoff actually make it difficult or impossible for non-Jews to invest with him? Or is my co-worker exaggerating the "Jewish" aspects of this story? ((PS...
