Another day, another opportunity to debate amongst ourselves whether or not Bernie Madoff will have his bail revoked. If you feel like we’ve had this conversation 875 times, it’s because we have. This afternoon, a hearing is scheduled to appeal Judge Ronald L. Ellis decision that the Ponz. master be allowed to remain in the comfort of his home at 133 East 64th Street. On Monday Ellis said he could but only with obscenely stringent restrictions, like mail checks, apartment sweeps (every couple weeks, natch), and no transferring of assets. Should we be stocking up on soap attached to a rope for Big B’s stay downtown or will he most likely get off, once again?

It is very, very rare for the first judge to be overruled on anything but actual points of law (rather than just what the public would prefer).
You might not like Ellis’ ruling, but it is in accordance with the law. Will not get overturned.

I think he’ll get to stay home. Not the favored outcome, but I think it’s the most likely one.
The judge’s decision was a careful examination of the facts and law. It will not get overturned. Please remember that the prosecutors signed off on the original bail package, saying, in effect that he is not a flight risk. No way he goes to jail today. Sorry.
If I were Madoff, I’d have all my money stashed in the Cook Islands. Impossible to get any assets out of there because, well, that’s what the tiny island nation set out to ensure when they created their “banking” system about 15-20 years ago.
