Madoff: Bail, No Jail

Judge Ellis will not revoke bail. Bernie to remain under house arrest. The AP reports that restrictions on transferring assets are now part of the bail, mail will be checked, and the apartment will be examined once every two weeks. That, I think we can all agree, are some harsh terms right there.

    This was totally a tactic to scare him into talking. He must have sung this weekend to stay out.
    It is outrageous that people have to sell their homes, jewelry, etc. while Bernie is relaxing at home – on THEIR money.
    Guy hasn’t made an honest buck in years (if ever) – and yet is still allowed to live off others’ money. No wonder people hate Wall Street. Even I do now and I work there.

    This “economic danger to the community” theory is total crap.
    Pretrial incarceration exists for two reasons: flight risk and real danger to the community.
    Madoff is going to jail for a long, long time. Whatever he gets will be a life sentence. Instead of wasting our time with these pretrial antics, let’s get him tried and in Federal PMITA prison pronto.
    I hope Bernie does try to make a break for it – imagine the compelling television as he drives around the upper east side with news cameras in tow and helicopters overhead – making a break for the Third Avenue bridge.
    Haven’t you people seen Escape from NY? It’s not like he’s going to be able to get off the island…

    Try google maps – or go walk past. Aside from the mass of news media, you’ll see the agent (security guy?) in the car with Georgia plates idling out front.

    @31 it’s not too impressive. But in Manhattan it’s hard to judge from the outside – I mean wouldn’t you rather pay up for good views than pay for an expensive building that other people can see?
    Still 64th & Lex is not that great of a neighborhood. He’s a couple of blocks up from Bloomingdales and right in the middle of the 59th St. Bridge traffic and gets some of the overflow from the park transverse.
    I guess it was close to work – just a ~10 block commute.

    @40: the average criminal who steals something does not get the option of posting bail and living in a penthouse with his own hired security. He just gets put in jail. Maybe he can come up with bail, maybe not. But he is jailed.

    The court wants as few as possible grounds for appeal here. If he takes a plea, he goes to jail in a leisurely fashion. If he goes to trial, we do not want him ot on bail during the appeal. That’s the wrap.

    #28 Except he VIOLATED THE TERMS of his parole.He INTENTIONALLY tried to hide valuable assets when he knew they might be confiscated by the courts to pay back people who lost money because of him. If any of us did this we would be in jail right now.
    This only sends the message to other rich people that if they do something illegal, they will be able to stay home in the comfort of their fancy homes having servents provide fancy meals for them while ANYONE else would be stuck in a jail cell.
