Lets not forget that a lot of the so-called victims are in the same boat as Ruth - basically people who've been living large by spending gains that it turns out were illusory. Most of them are probably home soiling their incontinent briefs hoping that no one will come by looking for a clawback. It would be entertaining to see a cam follow some of them around as well.

Investor sells business for $80, invests with Madoff, withdraws $200 over the past 15 years, has a statement balance on 12/9/08 of $450 (there is such a case, as reported in WSJ yesterday). 12/10/08 he learns that the whole thing is a ponzi scheme. You would say that he lost $450 and is a victim. I would say he gained $120 million ($200 withdrawn minus $80 original investment) and is far from a victim.

Also, every nickle is tied up in partnerships/entities etc, which for a prosecutor at some point doesnt make sense to go after the last $10 million

Its usually OK, take 70%; so...30% of $100 million is....
