@47 - you're probably spot-on about hiding things in one's office. My intuition is that the hammer fell on him before he could get rid of the stuff on his own. IF the theft-of-trade-secret allegations are what they purport to be, there wouldn't have been much need to plant stuff, and LOTS of down-side exposure. @27-31 - You can plot your departure, but on your own time and nickel. And you can't steal your company's trade secrets (including client lists, proprietary information management systems, etc.). Meanwhile, while you're employed there as sr. management, you indisputably owe your company fiduciary duties, even if they're about to shit-can your ass. Still think the inclusion of the sex/drugs stuff was the only poor move in the Quinn Emanuel complaint... Should have just alluded to it & let him stew about how it MIGHT come out in greater detail... My take is that Gundlach was hubristic enough to think that he could get away with what he was planning. It don't work like that, son. -ET!
Wow. The porn/drugs was a little salacious, but the factual allegations are over the top. If even 20% of the conspiracy allegations pan out, Mr. Gundlach and his crew are well, truly, and utterly fucked. The complaint should be Exhibit A in how NOT to run a conspiracy... They might be brilliant traders, but they were Keystone Kops here. Can't even set up a straw-man company properly - they used one of the co-conspirators as an organizing officer! ET-the-Judge slaps a TRO on the buffoons & smiles as they try to counter the allegations at the PI hearing ... in, say, 15 months. -- ET! (who's a lawyer IRL unassociated w/case, but quite familiar with these types of cases)
Without knowing more, it IS a jackass move by BoA. I've lived in both worlds (the Hill and big-firm litigation), & I know it'll inspire the congressional staff to give BoA a well-deserved m****rf**k. Even though BoA's policy is to archive the truly incriminating e-mails on the IT Department intern's girlfriend's Dell Inspirion 9200. But with all this, how come we've not seen the whole Towns letter in all its splendid, pecanish glory?
My goodness, it's a beautiful, big "screw YOU" to both the SEC and BOA's counsel. He throws down the gauntlet to the attorneys (by telling them they'll try the case in 4 1/2 months...) & instructing the SEC to pursue BOA's lawyers. Totally worth a read and a nasty, snarky laugh at the boyz/girlz who thought they were too clever by half. The only down side? It' Andy Cuomo's wet-dream.
@9 You've just about got it, except for the $100k/yr salary. Probably it's more like $75k/yr, although the useless f*ck might have gotten a locality raise. Still, you get what you pay for.Real lawyers from real law schools command upwards of twice that, & so you either get (a) earnest do-gooders, or (b) good b*llsh*tters. Either way, it's NOT the best and brightest. Well-meaning? Yes. But competent? Not necessarily. - ET! (who regularly hunts financial fraud on the civil side of things)
